EULA / Terms of Service

By accessing, purchasing, or using any Nixsy Breedables services, products, or the website located at www.nixsybreedables.com (the “Site”), you agree to comply with and be bound by these Terms (this “EULA / Terms”). If you do not agree, do not access or use Nixsy Breedables services.

Nixsy Breedables (“we,” “our,” “us”) is a third-party developer for the Second Life® platform. We are not affiliated with, sponsored by, or endorsed by Linden Lab or Second Life.

1) Eligibility

You must be 18 years of age or older to use Nixsy Breedables products and services.

2) License to Use

You are granted a limited, personal, non-transferable, non-exclusive license to use our virtual pets, HUDs, accessories, and related services (collectively, the “Products”) in Second Life.

You do not own the underlying scripts, systems, artwork, models, textures, code, or server services.

You may not resell, copy, modify, or distribute our Products outside the rules provided. We reserve the right to revoke this license at any time for violation of these Terms.

3) Permitted Use

• Use the Product for personal entertainment in Second Life.
• Transfer pets through normal Second Life transfer features (when enabled).
• Participate in official Nixsy events, breeding, and gameplay.

4) Prohibited Conduct

You agree not to:

• Hack, exploit, or otherwise interfere with the Nixsy Breedables system, Site, database, or in-world scripts.
• Copy, reverse engineer, decompile, or modify scripts, assets, or systems.
• Extract, reuse, or redistribute textures, models, meshes, or artwork.
• Create clones/duplicates, exploit objects, or bypass system limits.
• Use bots/automation to abuse breeding, points, markets, events, or any game mechanics.
• Attempt to access private server endpoints, trait pools, probabilities, admin tools, or restricted content.
• Upload illegal, harmful, or malicious content to our Site, database, or servers.
• Use our in-world chat channels or groups to spam, harass, or advertise unrelated products.
• Sell, resell, or redistribute Nixsy Breedables Products without authorization (other than official breedable pets or offspring/babies's, when applicable).
• Engage in any activity that violates United States law or Second Life Terms of Service.

5) Server-Backed Features

Parts of the Product rely on external services (servers, APIs, storage). You acknowledge that these features may change, be updated, paused, or discontinued to improve stability, security, or gameplay.

System rules (breeding limits, cooldowns, rarity logic, unlock rules, etc.) may evolve, change or be updated as the ecosystem grows.

6) Fair Play & Enforcement

We reserve the right to protect the ecosystem and community. We may block accounts or pets that exploit bugs, abuse systems, or violate these Terms.

• We may revoke in-world duplicates and correct exploit-related data.
• We may roll back or repair pet data when needed to maintain system integrity.

7) Termination of Access

We reserve the right to suspend or terminate your use of Nixsy Breedables services for reasons including (but not limited to):

• Code exploitation, tampering, or reverse-engineering.
• Disturbing the peace of the community.
• Repeated violations of group or in-world community guidelines.
• Requests from law enforcement with proper evidence.

Termination may occur without notice and at our sole discretion.

8) Purchases & Refund Policy

Purchases of Nixsy Breedables Products are final. We do not provide refunds or exchanges unless required by applicable law.

By purchasing, you acknowledge that virtual items are intangible and hold no real-world monetary value outside the Second Life platform.

9) Disclaimer of Warranties

Nixsy Breedables Products are provided “as is” and “as available” without warranties of any kind. We make no guarantees of uptime, availability, or error-free operation.

We are not responsible for issues caused by Second Life outages/rollbacks, Linden Lab policy changes, or technical limitations of the platform.

10) Limitation of Liability

• We are not liable for damages, direct or indirect, arising from use or misuse of our Products.
• We are not responsible for experiences between users in chat, trades, or in-world interactions.
• We are not liable for delays or interruptions caused by server issues, internet failures, force majeure, or other events beyond our control.

11) Privacy

We may collect limited information (such as Second Life username, UUID, or other identifiers) in order to provide our services.

We will never request your Second Life password.

12) Intellectual Property

“Nixsy Breedables” is an unregistered trademark of Misfit Crew Gaming. All content on the Site and within our Products (including graphics, textures, models, names, and software) are the property of Nixsy Breedables unless otherwise noted.

You may not reproduce, distribute, or create derivative works without express written permission.

13) Changes to Terms

We may update these Terms at any time by posting revised terms on the Site. Your continued use of Nixsy Breedables Products after changes are posted constitutes acceptance of the new Terms.

14) Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved under applicable state and federal law.
